Job description
PepsiCo is seeking an experienced and motivated Intellectual Property attorney to join its team of professionals that support PepsiCo's global R&D organization. The role will have a strong emphasis on negotiation and completion of agreements for PepsiCo R&D to protect the confidentiality, ownership and use of PepsiCo innovations and PepsiCo-sponsored research. The attorney will also play an important role in evaluating PepsiCo's technical development opportunities and diligently pursuing patent procurement / trade secret protection. Client counseling and training is a substantial component of this role. The position reports to PepsiCo's Global Intellectual Property Counsel.
The PepsiCo Law Department offers a prestigious position for a select professional to give world class legal support to an outstanding client base.
Responsibilities include:
Respond to needs within the attorney's assigned PepsiCo businesses for confidentiality, consultant, development and other agreements.
Lead the R&D contract request and management process
Routine training of R&D clients on various aspects of intellectual property protection.
Hands-on interaction with and counseling to the attorney's assigned R&D teams in the areas of patent risks and opportunities.
Supervise patent prosecution by outside U.S. and foreign patent counsels.
Conduct or supervise intellectual property assessments of business risks that include right-to-use studies and patent analyses for infringement and validity issues.
Liaise with PepsiCo's regional attorneys to insure coordinated support for R&D teams worldwide.
Regularly consult with Global Intellectual Property Counsel on outstanding patent prosecution / trade secret matters for assigned PepsiCo businesses.
Support Global Intellectual Property Counsel on ex-patent procurement matters; including assistance on patent licensing, patent enforcement actions by PepsiCo businesses against others, and defense of PepsiCo businesses from alleged patent / trade secret infringements.
Position Requirements:
Minimum of 5 years experience, including negotiation of R&D agreements (e.g., confidentiality, consultant, development and other agreements), patent prosecution and counseling, and an in-depth knowledge of U.S. patent and trade secret laws.
JD degree, a member of at least one state bar, and, preferably, a licensed member of the Patent Bar. An undergraduate degree in engineering, chemistry, biology or food science or substantial experience in one of these disciplines is a must.
Outstanding written and verbal communication skills are essential. Ability to clearly communicate with R&D personnel, senior R&D managers, other in-house counsel, outside patent prosecution counsel, database support personnel, and others within PepsiCo and at outside law firms is essential.
Inherent leadership skills and ability to inspire confidence in client base are prerequisites for effective counseling in this position.

Native intellectual curiosity and mental stamina. Ability to project and explain the consequences of actions taken to protect Company inventions.
Ability to grasp technical concepts and to communicate with R&D personnel and develop patent strategies.
Superior organizational and prioritization skills to manage U.S. and non-U.S. portfolios of patents, patent applications, trade secrets and complex intellectual property matters.
Must be willing and able to travel up to 20% of the time.
