Job description
The Fidelity Charitable Gift Fund (“Fidelity Charitable”) is a public charity that sponsors the largest national donor-advised fund program, and also has a pooled income fund. Fidelity Charitable is governed by an independent Board of Trustees, whichy has hired Fidelity Investments as the service provider to the charity. Fidelity Investments provides all of the charitable organization’s employees and supports all of its functions: Program Development, Marketing, Service Delivery, Relationship Management, Finance, Technology, Risk and Compliance, and Fundraising.
The Director of Compliance is responsible for ensuring ongoing compliance with all applicable federal and state regulations, and identifying and adhering to best practices for the operation of a public charity and its programs. This position works across the Fidelity Charitable functions to identify and address areas of high risk and/or exposure, and to implement solutions in a rapidly changing environment driven by service, regulatory, process, and program changes. This position requires a deep understanding of the complex legal and regulatory requirements of operating a public charity and donor-advised fund program, and is responsible for ensuring that such requirements are integrated in the day-to-day business operations and program management.
REGULATORY COMPLIANCE
• Recognize, assess, and propose solutions to compliance/regulatory concerns; monitor, and participate in formulation of responses to, external regulatory and legislative actions, tax changes, legal issues, and audit matters, and follow up on findings and action items
• Responsible for state solicitation filings and preparation of federal and/or state tax and information returns for the charity
• Support business initiatives and program and service development by participating in business unit meetings, reviewing training materials, developing and reviewing policies and procedures, and providing advice on regulatory requirements and exempt organization best practices
• Assist in the management of the governance of Fidelity Charitable through Board of Trustees administration, and assist in the development and implementation of Board policies
• Ensure that the standards for all outreach materials, communications, press releases and other collateral for Fidelity Charitable are upheld, with any eye towards complying with Fidelity Investments’ and charitable organizations’ rules, regulations, and best practices
• Serve as internal legal resource on regulatory issues, including analysis of new regulatory rule proposals, identify those potentially impacting the business unit, and work with business partners to implement any necessary changes
• Establish and maintain effective relationships with Fidelity Charitable business partners by providing advice with respect to a wide range of compliance/regulatory and other daily issues
• Support, engage and consult with intermediary clients, as needed
• Manage complex projects, as needed
OTHER COMPLIANCE
• Serve as internal legal resource on all business issues; responsible for drafting and/or reviewingadvisory contracts, sponsorship agreement and other like contracts, and, when needed, escalates to and/or consults with Corporate Legal on complex legal/compliance matters
• Oversee special services for high net worth donors, including making pledges on behalf of Fidelity Charitable and overseeing the execution and reporting of international grants
• Collaborate with Director of Research on impact investments for high net worth donors, and perform due diligence on and recommends proposed impact investments
Desired Skills and Experience
Education and Experience
J.D strongly preferred
2-4 years practical tax or nonprofit experience
Significant charitable and/or estate planning experience
Skills and Knowledge
Substantial technical knowledge of public charity rules and regulations
Ability to build key partnerships and collaboration among differing functions
Demonstrated analytical and strategic skills
Strong problem-solving skills
Manage multiple priorities and goals, and balance intelligent risk-taking with business objectives
Strong organizational and communication skills
